Gegenstand der Arbeit ist die insbesondere bei Publikumspersonengesellschaften verbreitete und für die geschlossene Investment-KG gesetzlich zwingend angeordnete qualifizierte Treuhandbeteiligung. Bei dieser Gestaltung ist der Treugeber über seine Rechtsbeziehung zum Treuhänder hinaus unmittelbar in den Rechts- und Pflichtenkreis des Verbandsverhältnisses einbezogen. Im Anschluss an eine Analyse der Kautelarpraxis und Rechtsprechungsentwicklung erörtert der Verfasser, welche rechtskonstruktiven Möglichkeiten für eine Einbeziehung des Treugebers in das Verbandsverhältnis bestehen. Anschließend widmet sich die Arbeit anhand einzelner Mitgliedschaftsrechte und -pflichten der Frage, inwiefern eine Annäherung der Rechtstellung qualifizierter Treugeber mit der eines unmittelbaren Gesellschafters zulässig oder gar zwingend ist. Hierbei wird auch auf etwaige Besonderheiten im Rahmen der gesetzlichen Gleichstellung gem. § 152 Abs. 1 S.¿3 KAGB eingegangen.
