Das Hauptziel dieser Arbeit besteht darin, die Geschichte des Rechtspositivismus zu analysieren, einer dogmatischen Strömung, die in der Zeit zwischen dem 19. und der ersten Hälfte des 20. Jahrhunderts unter Juristen weit verbreitet war. Zu diesem Zweck wird die Analyse mit den zentralen Konzepten beginnen, die der Rechtsgeschichte zugrunde liegen, nämlich dem positivistischen Recht und dem Naturrecht. Zu diesem Zweck wird die Entwicklung sowohl des positiven Rechts als auch des Naturrechts untersucht, wobei ihre wichtigsten Merkmale herausgestellt werden. Darauf folgt eine Untersuchung des Rechtspositivismus anhand seiner Hauptmerkmale sowie seiner Entwicklung im 19. und frühen 20. Nach der Darstellung der Merkmale und der wichtigsten positivistischen Schulen wird das Denken von Hans Kelsen, einem der wichtigsten Vertreter dieser Lehre, untersucht. Die Analyse wird sich auf das Studium des Werkes Reine Rechtslehre sowie auf Juristen stützen, die dieses Werk analysieren.

The main objective of this work is to carry out a historical analysis of Legal Positivism, a doctrinal current that was widely dominant among jurists in the period between the 19th century and the first half of the 20th century. To this end, the analysis will begin with the central concepts that underpin the history of law, namely positive law and natural law. For this analysis, the evolution of both positive law and natural law will be studied, highlighting their main characteristics. This will be followed by an examination of Legal Positivism based on its main characteristics, as well as its development throughout the 19th and early 20th centuries. Once the characteristics and main positivist schools have been presented, the thought of Hans Kelsen, one of the main names and exponents of this doctrine, will be examined. The analysis will be based on the study of the work Pure Theory of Law, as well as jurists who analyze this work.

L'objectif central de cet ouvrage est d'analyser l'histoire du positivisme juridique, un courant doctrinal largement dominant chez les juristes entre le XIXe siècle et la première moitié du XXe siècle. Pour ce faire, l'analyse partira des concepts centraux qui sous-tendent l'histoire du droit, à savoir le droit positivé et le droit naturel. Pour cette analyse, l'évolution du droit positif et du droit naturel sera étudiée en mettant en évidence leurs principales caractéristiques. Nous examinerons ensuite le positivisme juridique en fonction de ses principales caractéristiques, ainsi que son développement tout au long du XIXe siècle et au début du XXe siècle. Une fois les caractéristiques et les principales écoles positivistes présentées, la pensée de Hans Kelsen, l'un des principaux noms et représentants de cette doctrine, sera examinée. L'analyse se fondera sur l'étude de l'ouvrage Théorie pure du droit, ainsi que sur les juristes qui analysent cet ouvrage.
