La questione del diritto alla salute rimane una grande preoccupazione per tutta l'umanità, data la sua natura fondamentale, nella misura in cui la sua attuazione è strettamente legata ad altri diritti umani e la sua realizzazione dipende dal diritto a un'assistenza sanitaria di qualità, a un'alimentazione nutriente, a un alloggio dignitoso e sano, al lavoro, alla vita e a un ambiente sano. Pertanto, l'efficacia di questo diritto nella RDC è in discussione, poiché la "buona salute" di tutti sta diventando un'utopia a causa dell'incapacità dello Stato di creare le condizioni per il soddisfacimento dei diritti economici e sociali che sono interdipendenti con il diritto alla salute; la circolazione di farmaci di dubbia qualità; l'assenza di leggi sulla produzione e la vendita di farmaci e la pratica della medicina tradizionale, ecc.
