The street markets stretch for 3 or 4 blocks and you can find everything such as meats, fish, vegetables, rice, snacks, hardware and tools, herbal medicines, and everything you can imagine. You can see the tailors and also you can get haircuts in the street market. They are open no matter what, rainy or hot or stormy, you can go there and shop. Me, I like to go to the local street market because I can see their daily life activities, different cultures, and traditions.

إن النمطية المعرفية - التي راجت بين أغلب الفقهاء وتراوح مكانها - ألقت بظلالها الداكنة على فهم أسس واعتبارات الاجتهاد الفقهي، ولم تسلم منها طريقة التعاطي مع مصادر الأحكام الشرعية أيضا. كما أن العقليات التي حكمت عملية التفقّه، وما أفرزتها من معايير ومقاييس محددة، والتعلّق الشديد ببعض الرموز والشخصيات التاريخية غير المعصومة، هي التي واكبت عملية تقييم درجات اعتبار تلك الأسس والموازين، وكيفية تطبيقها في الواقع والميدان، وأثّرت على مستويات التعاطي المعرفي والاستنباطي معها، وتم ربط كل ذلك بقواعد شكلية وأعراف عملية، قيّدت الاجتهاد من جميع جوانبه، ولم يُبق له مجال للتحرك النظري، ولا للإبداع الفكري، ولا للعطاء العملي والميداني. سبق لي أن بحثت مفصلا عن مشكلة الاجتهاد في الواقع العملي وقدمت بدوري اقتراحات محددة للخروج عن النمطية السائدة وتجاوز الاجتهاد الاستدراكي المعمول به في حل مشاكل العباد( )، ولا أدخل في دراستنا - هذه - في البحث عن تلكم الأمور وإنما أرمي هنا للبحث عن ما يمكن القيام به من أجل تطوير أدوات، مفردات، عناصر، أفكار، ضوابط ونظريات فقهية، ولا يعنينا هنا بشكل مباشر ما ينبغي العمل عليه من أجل تطوير عملية الاجتهاد - ذاتها - وتنظيم وتهذيب الخطوات الإجرائية له في العمل الفقهي، فهو مجال مستقل سبق وأن بحثنا فيه. إذن ففي هذه الدراسة، نسعى - بقدر ما يسمح لنا الوقت والمكنة - لتناول العناصر والجوانب التي يمكن من خلالها تطوير عملية الدرس والبحث الفقهيين، وذلك كتمهيد لبناء أسس الاستنباط على اعتبارات أكثر قدرة على التصدي لمشكلات الناس، وإعطائهم حلولا ومعالجات أكثر نفعا وأسهل تناولا، وأقدر على الصمود بهدف فتح منافذ نحو مستقبل أكثر إشراقا وتطورا.
