Der Widerruf der Approbation wegen Unwürdigkeit stellt einen tiefgehenden Eingriff in die Berufsfreiheit des einzelnen Arztes dar. Angesichts der Schwere dieses Eingriffs verwundert es, dass in der behördlichen Praxis dies ohne großen Begründungsaufwand geschieht. Neben der Darstellung der exzessiven Interpretation des unbestimmten Rechtsbegriffs und der dahinterstehenden Intention, zielt die Arbeit darauf ab, aufzuzeigen, was unter dem eigentlichen Vertrauen der Patienten in die Ärzteschaft zu verstehen ist. Ausgehend davon, will die Arbeit verdeutlichen, dass ein ausreichender Schutz dieses Vertrauens, wie auch in den untersuchten anderen Teilrechtsgebieten des besonderen Verwaltungsrechts, ausschließlich mit dem Begriff der Unzuverlässigkeit erreicht werden kann.

Este trabajo investiga la noción de progresividad del Análisis de la Conversación en una actividad conversacional específica: la narración colaborativa. Los resultados revelan la orientación de los participantes hacia la progresividad en diferentes niveles de la narración y muestran que la coparticipación en esta actividad es un logro multimodal complejo que trasciende las nociones tradicionales de hablante y oyente. Desde una perspectiva lingüística, el estudio presenta los beneficios de un acercamiento praxeológico multimodal al uso de las formas lingüísticas y muestra la interrelación entre recursos verbales y no verbales en la conversación.

El ingenio con el que históricamente las mujeres superan las barreras impuestas desde el poder patriarcal está subestimado. En el imaginario popular existen autoras que, a pesar de las imposiciones del silencio social, consiguieron que sus voces fueran oídas. Sus aportaciones son fundamentales para la actual configuración de nuestro paradigma cultural.Por lo tanto, para luchar contra las estructuras tradicionales limitantes es crucial reivindicar su labor en los distintos ámbitos culturales. La inclusión de perspectivas feministas debe facilitar una representación más equitativa de las experiencias humanas. Para lograrlo se deben impulsar las investigaciones que rescaten las voces femeninas. Literaturas, mujeres y silencio. Formas de silenciamiento femenino en la literatura reciente nace como un proyecto hacia este objetivo.

This book has two research objectives. The main objective is to present the dynamics of the system reform of the Economic and Monetary Union in 2010-2022. The other is to take stock of the reform and to highlight its successes and failures. In this context, the monograph puts forward two research hypotheses. The first hypothesis assumes that the shortcomings in EU primary and secondary law regarding the Economic and Monetary Union and the course of the euro area debt crisis were two main reasons for reforming the EMU, whereby the crisis in question actually forced the European Union and the euro area countries to implement the reform. The second hypothesis is based on the assumption that the implementation of the system reform encountered many difficulties and obstacles arising from the negative attitude of the governments of some euro area Member States to the execution of selected projects, but also from the accumulation of various severe crises that the European Union faced during the reform, in particular the euro area debt crisis, the migration crisis, the pandemic crisis and the geopolitical crisis following Russia's aggression against Ukraine. The research hypotheses were verified using a triangulation of several qualitative methods: case study, institutional-legal method, comparative method, and critical analysis of sources and literature.

Die Arbeit untersucht, inwieweit die zivilrechtliche Rechtsfigur des Rechtsmissbrauchs in der betrieblichen Mitbestimmung Anwendung finden kann. Zu Beginn erfolgt eine Systematisierung der zivilrechtlichen Rechtsmissbrauchslehre. Die Übertragung dieses zivilrechtlichen Missbrauchstatbestandes in das Betriebsverfassungsrecht erfordert eine Untersuchung des Rechtsverhältnisses zwischen Arbeitgeber, Betriebsrat und Arbeitnehmern. Ausgehend von dieser Klassifizierung wird dann die Übertragung in das Betriebsverfassungsrecht vorgenommen. Die Prüfung der Anwendbarkeit des Rechtsmissbrauchs in der Betriebsverfassung ermöglicht im Anschluss eine Auseinandersetzung mit der betriebsverfassungsrechtlichen Rechtsfolge des Rechtsmissbrauchs. Dabei werden durchgängig Bezüge für die Rechtspraxis hergestellt.

Constitutional consciousness belongs not solely to the legal field, but also to other social sciences. It refers not only to constitutional and national identity but also to European identity, as the general principles of EU law derive from common constitutional traditions. Its low level results with difficulties in the proper reading of the legitimacy of power and with the recently widely discussed democratic deficit both in member states and in the EU itself. The publication addresses the issue of European integration and the common catalogue of values and human rights. The aim is to point out that increasing its level in society shall bring remedy for the democratic deficit in the EU and strengthen respect for fundamental rights. This thesis gives the publication an innovative Character.

Über vierzig Jahre lang brachte Willis Conover ab den 1950er Jahren allabendlich den Jazz via Kurzwelle in die Welt. Besonders in den ehemaligen Ostblockländern wurden Conover und seine Sendungen zu einem Mythos. Während die Kulturpolitiker beider Seiten versuchten, Jazz als Propagandawaffe zu nutzen oder ihn zu bekämpfen, bildeten die entstehenden Jazzkontakte eine wichtige kulturelle Brücke zwischen Ost und West. Diese Doppelfunktion des Jazz als Waffe oder Brücke analysiert das Werk anhand von bislang ungenutztem Archivmaterial aus den USA, Russland und den wichtigsten ehemaligen Ostblockstaaten sowie Conovers Nachlass und Zeitzeugenberichten.

La tecnología de la traducción se utiliza ampliamente en casi todos los ámbitos en los que se identifican necesidades multilingües, al menos en entornos comerciales. Curiosamente, las necesidades multilingües de las ONG que trabajan en el ámbito de las migraciones parecen haber caído en el olvido en lo que respecta a la tecnología de la traducción. Esta monografía surge con el objetivo de cubrir este vacío mediante una aproximación rigurosa a la tecnología de la traducción aplicada al ámbito de la migración en áreas como la implementación de la traducción automática, el apoyo a las tareas de posedición, la idoneidad de las plataformas de traducción basadas en la web, la percepción de los traductores sobre la tecnología y el flujo de trabajo de la traducción.

Aunque suele considerarse El Llano en llamas como punto de partida del cuento mexicano de la segunda mitad del siglo XX, también puede verse como la culminación de una serie de itinerarios que la cuentística del país emprendió a finales del XIX, desarrolló durante la lucha armada revolucionaria, se actualizó con el polémico transcurrir de las vanguardias, se polarizó con la política cultural revolucionaria y la entronización de la literatura comprometida durante el cardenismo, y arribó a un espacio de encuentro al generalizarse el desencanto provocado por el fracaso de la Revolución. Este tomo estudia la mirada internacional de la Guerra Civil y el franquismo. El libro aborda testimonios, memorias, ficciones excéntricas, que incluyen textos olvidados, autores exiliados o la producción en otras lenguas, y los circuitos españoles extranjeros. Se presenta un estudio introductorio, seguido por 21 artículos en tres bloques. El primero indaga en la recepción del conflicto en la cultura americana, revisando el impacto en revistas, periódicos, antologías, libros y actividades culturales. En el segundo bloque se analiza la producción testimonial de reporteros de Gran Bretaña y Polonia, y la repercusión de la contienda en la prensa noruega. El tercero se centra en la mirada europea, abordando diferentes representaciones de escritores extranjeros.

Das Buch beschäftigt sich mit den Herausforderungen der Fremdsprachenforschung im Bereich der Aufgabenorientierung und empirischen Unterrichtsforschung. Ausgangspunkt vieler Beiträge ist die Auseinandersetzung mit den Arbeiten von Bernd Tesch, die sowohl die rekonstruktive Unterrichtsforschung wie auch die Aufgabenorientierung im Fremdsprachenunterricht beeinflusst haben. Dabei werden verschiedene Perspektiven aus Fremdsprachendidaktik, Erziehungswissenschaft sowie Literaturwissenschaft betrachtet und sowohl separat als auch in Beziehung zueinander diskutiert. In den Beiträgen werden aktuelle Forschungsthemen beleuchtet und sowohl konzeptionelle als auch empirische Aspekte der Aufgabenorientierung und Unterrichtsforschung untersucht. Aufgezeigt werden somit nicht nur die Potenziale sondern auch die Grenzen dieser beiden Bereiche und (aktuell noch offene) Forschungsfragen sowie Perspektiven für die Zukunft.

Dieser interdisziplinäre Sammelband geht den Möglichkeiten nach, die sich durch die intensive Erforschung eines Objekts (Grabkrone Konrads II. in Speyer) oder die Verbindung von Schriftquellen und anthropologischer Fundsituation (Philipp von Schwaben) ergeben. Er fragt nach Grabgestaltung und Grabdenkmälern, nutzt germanistische, epigraphische, mentalitätsgeschichtliche und Digital Humanities-Methodiken. Wie sterben Frauen in der mittelalterlichen Literatur, wie spricht man im Mittelhochdeutschen über den Tod? Und wie geht man damit um, wenn der Leichnam fehlt, weil der Kaiser fern seines Reiches in Kleinasien auf dem Kreuzzug verstirbt? Zusammen ergeben sich damit neue Perspektiven auf ein erforschtes, aber längst nicht erschöpfend verstandenes, allgegenwärtiges Phänomen des menschlichen Lebens: Unser Sterben.

Umfangreiche Strafverfahren unter Beteiligung vieler Nebenkläger, wie der Prozess gegen den sog. Nationalsozialistischen Untergrund (¿NSU-Prozess"), stellen die Justiz vor organisatorische und rechtliche Herausforderungen. Das Verfahren vor dem Oberlandesgericht München war mitursächlich für die Einführung der gemeinschaftlichen Interessenvertretung in § 397b StPO. Die Untersuchung befasst sich mit den Auswirkungen der Nebenklagevertretung auf strafprozessuale Verfahrensgrundsätze, die Strafrechtspflege und die Beteiligung der Nebenkläger an der Hauptverhandlung.

The volume addresses the effectiveness of the teaching¿learning process during the pandemic and post-pandemic periods, beginning with the widely accepted hypothesis that the transition to a distance teaching system had a significant impact on the way didactic activities must be conceived, on the evaluation of school performance, and on how students can provide quality feedback to teachers regarding the efficiency of the educational process. As a result, a part of the studies focuses on the adoption of alternate ways of teaching¿learning evaluation, with an emphasis on enhanced interactivity, to compensate for the loss of direct connection. This is why a considerable number of studies use ludic or dramatic strategies in the teaching¿learning process, with the declared goal of integrating the interlocutors as much as possible, of transposing them into a more manageable reality.

The promotion of the conservation and sustainable use of forests is a crucial aspect of environmental protection. However, effective and legally binding international regulations specific to forests are still absent. The scope of this research is to analyse the existent international legal regime for forests and to elaborate approaches to the enhancement of its efficiency. The rigorous analysis of international documents leads, finally, to conclude that pure market-based mechanisms are not sufficient for the conservation of forests and stronger legally-binding provisions are needed. Based on these conclusions, the research proceeds with the analysis of possible ways of the development of international legal regime for forests, as well as the promotion of compliance with international treaties.

De forma assaz enfática, e muito consciente, o mundo medieval representa-se a si mesmo, nas suas múltiplas práticas sociais e estético-culturais, através da figuração animal. Pela mão de um assinalável conjunto de especialistas, esta obra faz-nos, assim, recuar a um tempo em que a realidade se inscrevia amplamente sob a égide representacional dos bichos; e, com isso, ajuda-nos a compreender, nós que vivemos em tempos de notória inquietação pelo vivente e de empatia pró-animal, os limiares homem/animal durante a Idade Média central e tardia. Mas também, implicitamente, se revela fundamental para refletir sobre as razões pelas quais os séculos pós-medievais, em nome da Modernidade, foram apagando do seu imaginário esses limiares.

This book suggests a theoretical framework for the non-democratic and illiberal donors of foreign aid and tests the empirical support of this framework. It aims to examine the foreign aid motivation and preferences of non-democratic and illiberal countries. The study applies the quantitative methodology to understand why nondemocratic and illiberal regimes provide foreign aid and what affects their aid preferences. The findings show that the nature of the relationship between the government and the business elite influences both aid motivation and aid preferences in those countries.

This book presents several theoretical proposals about social and familial ¿ but alsopolitical and cultural ¿ change in Spain in the transition from the Ancien Régime tothe modern age. The sociocultural reality of the Ancien Régime, based on inequalityand privilege, is redefined through kinship and, both horizontal and vertical, socialrelations. In this way, the transition from the patriarchal to the conjugal familyexplains continuity and change in the context of new social relations that valueindividual merit, the accumulation of capital, and the decisive importance of feelingand emotion.

This book attempts an innovative exploration of the connection between humour and scepticism in the English literary canon. Defining humour as a capability, or better put, as a dunamis, it looks into its ¿energeiac¿ forms of actualisation in the English literary imagination from Chaucer to Sterne. Refraining from attributing an essentialist tone and mode to the theoretical and critical reception of English humour, and also humour in a wider context, it works instead within a literary nominalist framework where it is explored as a literary phenomenon that sides with the living, the multifarious, and the experiential dimensions of human action. In doing so, it develops a broader argument concerning the nominalist overtones of English humour where its prominent scepticism purports an epistemological break with the dominant forces of universalism; an argumentative force which cyclically acquires its tenets from the preliminary discussion that focuses on the dynamicism of humour.

Welche Vorstellungen machen sich Lernende spontan von Autor*in, Genre und Entstehungszeit eines literarischen Textes, den sie gerade lesen, oder von den Reaktionen, die er ausgelöst hat und noch auslösen wird? Auf welches Wissen greifen sie dabei zurück, wenn ihnen keine zusätzlichen Informationen angeboten werden? Diesen bisher unbeachteten Fragen geht die vorliegende Laut-Denk-Studie mit Schüler*innen zehnter Klassen und Lehramts-Studierenden im Fach Deutsch zu drei Kurzprosatexten von Heinrich Böll, Bertolt Brecht und Enid Blyton nach. Sie rekonstruiert die Bildung mentaler Kontextmodelle als anspruchsvolle Denkarbeit, bei der fortgeschrittene Lernende vor allem auf populärkulturelle Fiktions-Erfahrungen und auf Schemata zurückgreifen, denen zufolge ,früher' (fast) alles schlechter war.

Die vorliegende Dissertation untersucht den Grundsatz der Gläubigergleichbehandlung auf nationaler und europäischer Ebene im Vergleich. Sie stellt die historische Entwicklung, den Zweck sowie Ausprägungen und Durchbrechungen des Grundsatzes in den Fokus. Die Arbeit kommt zu dem Ergebnis, dass der Grundsatz der Gläubigergleichbehandlung auf europäischer Ebene auf den Grundsatz der Gläubigergleichbehandlung nationaler Rechtssordnungen zurückzuführen ist, wobei die Grundsätze dennoch unterschiedliche Aufgaben erfüllen. So stellen nationale Umsetzungen die Verteilungsebene in den Mittelpunkt. Auf europäischer Ebene wird in erster Linie die Teilnahme am Verfahren, die Verteilungsgerechtigkeit innerhalb mehrerer Verfahren sowie der Antidiskriminierungsgedanke innerhalb einer multi-nationalen Gläubigergemeinschaft adressiert.
