Der Europäische Gerichtshof in Luxemburg und der Europäische Gerichtshof für Menschenrechte in Straßburg haben konkret über die Pflichtmitgliedschaft noch nicht geurteilt. Eine Analyse der bisherigen Rechtsprechungspraxis dieser Gerichte gibt jedoch Aufschluss darüber, wie zu entscheiden wäre: Die Pflichtmitgliedschaft in den deutschen Industrie- und Handelskammern verstößt gegen europäisches Recht.
