Ziel der Dissertation ist die Entwicklung einer Antwort auf die Frage, wo das Gewissen als Sachverhalt, auf den das Recht an vielen Stellen rekurriert, in einer pluralistischen Welt noch eine objektive Grundlage, einen Ruckhalt finden kann. Hierfur wird das Gewissen aus einer Teilnehmerperspektive als genuin menschliche Haltung verstanden.

Die Autorin behandelt die Frage nach der Haftung von Nebentatern und das Sonderproblem des Mitverschuldens. Als ein unklar definierter zivilrechtlicher Begriff in deutschen und chinesischen Rechtsordnungen ist die Rechtslage der Nebentaterschaft in Deutschland gesetzlich unzureichend fixiert und widerspricht den relevanten chinesischen Regelungen.

Die Studie behandelt die geisteswissenschaftlichen Facher Geschichtswissenschaft, Germanistik sowie Slawistik an der Deutschen Universitat Prag.
