Om Corporate liability under Guinean law
La responsabilité pénale des personnes morales en droit Guinéen is a work of general criminal law which describes with pointed criticism the legal conception of this notion in this French-speaking African country. It details the history and evolution of the criminal liability of this category of person from independence in 1958 to the present day. The author points out that, for a very long time, the country held legal entities criminally irresponsible, before making provision for this abstract person to be prosecuted by the criminal courts.This work is divided into two main parts, the first of which is devoted to what he calls liability based on partiality, which he justified by the fact that the State is criminally irresponsible, but that certain dismemberments of the State are partially liable. He went on to point out that all other legal entities with legal personality are criminally liable. In this same first part, he recalled the conditions for implementing the criminal liability of legal persons, and the difficulties to be expected.
